This cancellation policy applies to Retro Hotel Garage, Martinovská 3263, Ostrava-Martinov, Czech Republic
Introduction
- This cancellation policy applies to cancellations of reservations for accommodation services made between the customer for accommodation services and the accommodation provider (= the operator of the hotel).
- The cancellation fee is calculated from the total amount of the order.
- The cancellation fee is compensation for the damage caused to the accommodation provider.
- The accommodation provider reserves the right to issue an advance invoice. The advance invoice is payable within 7 days from the reservation. The advance payment is 50% of the total amount of the booked stay, unless the accommodation provider and the customer agree otherwise.
- If a stay is cancelled for which an advance payment has already been made, and under this cancellation policy the advance paid is higher than the cancellation fee, the accommodation provider must return to the customer the amount that exceeds the cancellation fee.
- If the stay is ended early or interrupted through no fault of the accommodation provider, the accommodation provider has no obligation to return to the customer the price paid for the stay or any proportional part of it.
Cancellation policy for cancellation of the accommodation reservation by the guest
- The accommodation provider agrees not to charge cancellation fees if the reservation is cancelled up to 21 days before the announced arrival.
- If the reservation is cancelled 20 – 14 days before arrival, a cancellation fee of 25% of the total price of the stay will be charged.
- If the reservation is cancelled 13 – 7 days before arrival, a cancellation fee of 50% of the total price of the stay will be charged.
- If the reservation is cancelled 6 – 2 days before arrival, a cancellation fee of 75% of the total price of the stay will be charged.
- If the reservation is cancelled 1 day before arrival or on the day of arrival, a cancellation fee of 100% of the total price of the stay will be charged.
- If the length of the stay is shortened, the same cancellation periods apply as for a cancellation of the stay.
- The cancellation fee is a contractual penalty.
If the cancellation is due to unavoidable events (death in the family, hospitalisation of the customer or a member of their family, serious illness, natural disaster), no cancellation fee is charged. The customer must prove the above facts to the accommodation provider with a written document no later than 3 days after they occur.
If the cancellation is due to other serious reasons, a change of dates is possible by mutual agreement.
This cancellation policy applies to individual guests and to group reservations.
If no advance payment was made from which the cancellation fees could be deducted, the accommodation provider has the right to send the customer an invoice for the amount of the cancellation fees.
Cancellation policy on the part of the accommodation provider
- The accommodation provider has the right to cancel towards the customer at any time. If the accommodation provider cancels more than 5 days before the agreed start of the stay, the other party has no right to compensation for the damage incurred or for any additional costs incurred in connection with alternative accommodation of these persons.
- A circumstance that excludes the liability of the accommodation provider for damage to the customer is also the fact that the accommodation provider cancels towards the customer more than 6 days (inclusive) before the agreed start of the stay.
- If it is not possible to proceed under point 1 for legal reasons or for reasons expressly agreed between the accommodation provider and the customer, the accommodation provider is liable for any damage up to a maximum of CZK 2,000 or up to 1/20 of the damage actually incurred – whichever amount is higher for the entitled party applies. Loss of profit is not compensated in any case.
Cancellation policy for unused stay vouchers, vouchers issued by third parties, and changes to the length and type of stay made through vouchers:
- A voucher is a document used to pay for a stay or services instead of payment by invoice, cash or payment card.
- For stays paid by voucher, the same conditions for cancellation or change of the reservation before arrival apply as described in the paragraph: Cancellation policy for cancellation of the accommodation reservation by the guest.
- The cancellation fee is a contractual penalty.
- Unused vouchers become invalid when their validity period ends.
Final provisions
- These conditions are valid and effective from 1 May 2017.
- Relations between the customer and the accommodation provider are governed by the provisions of this cancellation policy.
- This cancellation policy applies only to confirmed written orders (e-mail, letter, fax).
- Both the accommodation provider and the customer can cancel an order for a stay only in writing (e-mail, SMS).
- These business terms remain in effect after the end of the accommodation contract between the accommodation provider and the customer.
