Retro Hotel Garage (hereinafter also the “hotel” or the “accommodation provider”), operated by Woodman Production a.s., IČO: 25394886, DIČ: CZ25394886, with its registered office at Martinovská 3262/50, 723 00 Ostrava – Martinov.
1. Conditions for concluding the accommodation contract
Guests are accommodated at Retro Hotel Garage on the basis of an accommodation contract concluded under § 2326 et seq. of Act No. 89/2012 Coll., the Civil Code. Under this contract, hotel Garage (hereinafter the “accommodation provider”) provides the accommodated person with temporary accommodation for the agreed period, or for the period that follows from the purpose of the accommodation, in a facility intended for this purpose, and the accommodated person (hereinafter also the “guest”) agrees to pay the accommodation provider for the accommodation and the related services within the period set by these house rules (hereinafter also the “contract”).
The accommodation contract is always concluded in writing. To meet the form requirement, at least a written confirmation of the reservation order or the completion of a registration card is sufficient
The rights and obligations of the contracting parties that the accommodation contract does not expressly govern are governed by these house rules and the price list of the accommodation provider. If the accommodation contract sets something different from these house rules and/or the price list of the accommodation provider, the accommodation contract applies.
If the guest does not comply with the obligations that follow from the accommodation contract and the house rules attached to it and/or the price list of the accommodation provider, or otherwise breaches good morals in the hotel (hereinafter a “breach”), the accommodation provider has the right to terminate the accommodation contract before the end of the agreed period, also without a notice period, if the hotel has warned the guest of the breach under § 2331 of the Civil Code.
2. Conclusion of the contract, reservation
The guest must place the accommodation order with the accommodation provider in writing, or make a reservation by telephone and then confirm it to the accommodation provider in writing. A written reservation, or a confirmation of a telephone reservation under the previous sentence, means an order made through the reservation form, by e-mail to the accommodation provider at recepce@woodman-as.cz, or by post sent to the address of the hotel and/or the operator given in the heading of these house rules.
When the accommodation provider receives from the guest a written order or a written confirmation of the reservation, it issues to the guest an advance invoice for an advance payment of 30% – 50% of the expected price of the accommodation, and sends it to the guest at the address the guest gave in the order under point 2.1 of this article. The guest must pay the advance within the period and under the conditions given in the advance invoice. An advance payment is not required only for stays reserved seven or fewer calendar days before the requested day of arrival.
In that case, the full price of the accommodation is paid at the time of arrival.
The accommodation contract is concluded at the moment the accommodation provider receives the written order or the written confirmation of the reservation, or when the guest completes the registration card.
3. Cancellation of the reservation, withdrawal from the contract before arrival, failure to arrive for the accommodation
If the guest does not pay the advance under Art. I, para. 2.2 correctly and/or on time, the accommodation reservation is cancelled when the due date of the advance invoice passes without payment.
The guest has the right to withdraw from the accommodation contract before the day of arrival, also without giving a reason. The guest must deliver a written notice of withdrawal from the contract to the accommodation provider. In this case, the accommodation provider has the right to charge the guest a cancellation fee, calculated from the amount of the advance paid, at the following rates:
The accommodation provider agrees not to charge cancellation fees if the reservation is cancelled up to 21 days before the announced arrival.
If the reservation is cancelled 20 – 14 days before arrival, a cancellation fee of 25% of the total price of the stay will be charged.
If the reservation is cancelled 13 – 7 days before arrival, a cancellation fee of 50% of the total price of the stay will be charged.
If the reservation is cancelled 6 – 2 days before arrival, a cancellation fee of 75% of the total price of the stay will be charged.
If the reservation is cancelled 1 day before arrival or on the day of arrival, a cancellation fee of 100% of the total price of the stay will be charged.
If the length of the stay is shortened, the same cancellation periods apply as for a cancellation of the stay.
The cancellation fee is a contractual penalty.
If the guest does not arrive for the accommodation within 24 hours after the agreed arrival, the accommodation provider has the right to withdraw from the accommodation contract and also has the right to charge the guest a cancellation fee of 100% of the advance paid. This does not apply if the customer informs the accommodation provider of a later arrival in advance, by telephone or in writing, but no later than 1 day before the planned arrival. The conditions given in Art. 2, para. 2.1 of these house rules apply accordingly to the form of this notice.
4. Arrival at the hotel/guesthouse
The guest announces their arrival to the authorised employee at the hotel reception.
At the reception, the guest shows their identity card, or passport or other identity document (e.g. a residence permit), which the authorised employee of the accommodation provider uses to verify the identity of the guest. The guest confirms that their personal data and the period of stay are correct with their signature on the registration card or in the accommodation book of the accommodation provider.
Unless agreed otherwise, check-in of arriving guests takes place from 14:00 to 16:00
On arrival, the guest pays the balance of the accommodation price, i.e. the agreed accommodation price less the advance paid under Art. 2, para. 2.2 of the house rules. After the balance of the accommodation price is paid, the accommodation provider issues to the guest a tax document that confirms payment for the full stay. This does not affect the last sentence of Art. 2, para. 2.2; in that case the accommodation provider issues to the guest a tax document that confirms payment for the full stay. On arrival, the accommodation provider has the right to ask the guest to show a payment or credit card as a guarantee of payment up to 100% of the expected accommodation price. After the end of the accommodation, the accommodation provider has the right to authorise a payment from this card for the amount that covers the actual accommodation price and the other costs related to the accommodation, also without the guest being present (off-line). By providing their payment or credit card, the guest gives consent to this.
On arrival, the accommodation provider has the right to ask the guest to pay a cash deposit of CZK 1,800 per room. The deposit is returned on departure, in full or in a reduced amount under the conditions given in Art. 7 of these house rules.
The authorised reception employee informs the guest about the house rules no later than on the day the guest arrives.
The number of persons in the room is the same as the number of persons registered for the accommodation. The guest agrees to state their exact number at registration.
The period of accommodation is agreed no later than when the guest checks in, and is recorded in the accommodation book or on the registration card. The period of accommodation can be extended only with the consent of the accommodation provider and must be supported by an entry in the accommodation book or on the registration card.
The guest hereby gives consent to the accommodation provider to process and store their personal data, to the extent of the data provided, for the purpose of providing accommodation and keeping records of guests under Act No. 565/1990 Coll., on Local Fees, and Act No. 326/1999 Coll., on the Residence of Foreign Nationals in the Territory of the Czech Republic and on Amendments to Certain Acts. The specific obligations of the guest and the accommodation provider for keeping the register book or house book are set by the above legal regulations.
5. General rules of accommodation
The guest has the right to use the space reserved for their accommodation, the common areas of the hotel/guesthouse, and the services related to the accommodation.
On arrival, the guest receives a key, or a magnetic or chip card, for the room and for the entrance to the hotel/guesthouse (hereinafter together the “keys”). The guest must prevent loss, destruction or damage of these keys, and must not make the keys available to third persons who are not a direct party to the applicable accommodation contract made between the guest and the accommodation provider. Any penalties for loss, destruction or damage of the keys, or for making them available under the previous sentence, are set in the accommodation contract.
The guest must:
- read and comply with the house rules;
- pay the accommodation price under the applicable price list;
- use the accommodation areas correctly, and keep all accommodation areas tidy and clean;
- make sure that the accommodation areas are kept clean;
- protect the equipment in the accommodation areas against damage;
- immediately report any damage or loss that the guest or the persons accommodated with the guest caused in the hotel/guesthouse;
- from 22:00 to 07:00, behave so as not to disturb other persons with excessive noise;
- when leaving the room, close the water taps, switch off the lights, switch off electrical appliances that are not used while the guest is away, and close the windows;
- when leaving the hotel/guesthouse, return the room key (magnetic stripe card) to the reception
Without the consent of the accommodation provider, the guest must not:
- make significant changes in the accommodation areas (move furniture, move equipment, etc.);
- take away any equipment or fittings from the accommodation areas;
- use their own appliances in the accommodation areas, except small appliances used by the guest for personal hygiene and office work;
- let another person use the accommodation areas;
- receive visitors in the accommodation areas; visitors must be correctly recorded in the visitors’ book or announced to the reception employee, and visits are possible only from 14:00 to 22:00 with the consent of the accommodation provider; guests can receive visitors only in the common areas of the hotel;
- give the address of the building with the accommodation areas as their place of business;
- bring animals into the hotel/guesthouse. The owner of an animal must, at the request of the staff of the accommodation provider, prove that the animal is healthy by showing a valid vaccination certificate.
Also, in the accommodation areas the guest must not:
- carry weapons, ammunition and explosives, or otherwise keep them in a condition that allows their immediate use;
- possess, produce or keep narcotic or psychotropic substances or poisons, unless they are medicines that a doctor prescribed to the guest;
- smoke; this does not apply to areas reserved for smoking and visibly marked with the applicable symbol;
- use open fire
6. Liability of the accommodation provider for the guest’s belongings
If the guest asks, the accommodation provider takes money, jewellery or other valuables from the guest into safekeeping. The hotel has the right to refuse to take items into safekeeping if they are dangerous or if their value or size is not appropriate for the accommodation facility. This applies in particular to money or items (e.g. jewellery and other valuables) with a value of more than CZK 100,000. The accommodation provider requires that items for safekeeping are handed over in a closed or sealed container.
A claim for compensation for damage to the guest’s belongings can be made only within 15 days after the damage is found. The damage will not be compensated if the guest or a person accompanying the guest caused it.
If the guest leaves their belongings in the room after the end of the stay and the accommodation is not paid, the accommodation provider moves the guest’s belongings out of the room and stores them in a safe place to prevent damage. After the accommodation debt is paid, the accommodation provider gives the stored belongings back to the guest.
7. Safety, liability of the guest for damage caused
The guest must read the safety rules and the evacuation plan in case of fire. This plan is in each hotel room and is available for inspection from the applicable employee at the reception.
The guest acts so as not to cause unjustified harm to the freedom, life, health or property of another person.
If the guest’s actions cause damage to the property of the accommodation provider, the damage will be paid from the deposit paid under Art. 4, para. 4.5 of the house rules. If the damage is higher than the deposit, the guest must pay the difference to the accommodation provider.
The liability of the accommodation provider for damage to deposited items is governed by § 2945 et seq. of Act No. 89/2012 Coll., the Civil Code.
The liability of the accommodation provider for damage to items brought in is limited to 100 times the price of accommodation for one day. In other respects, it is governed by § 2946 et seq. of Act No. 89/2012 Coll., the Civil Code.
The accommodation provider does not operate a guarded car park and is therefore not liable for damage to vehicles and items left in them, unless the accommodation provider expressly declares that it has taken such items into its safekeeping.
8. Departure from the hotel
The guest must leave the room where they are accommodated by 10:00, unless agreed otherwise.
The guest locks the room and leaves the keys (card) at the hotel reception, unless agreed otherwise.
